Sexual harassment is another form of harassment and may involve individuals of the same or different gender. Sexual Harassment is any unwelcome conduct of a sexual nature that might reasonably be expected or be perceived to cause offense or humiliation. Sexual harassment may include, but is not limited to verbal (sexual innuendoes, suggestive comments, jokes of a sexual nature, sexual propositions, or threats); non-verbal (sexually suggestive objects or pictures, graphic commentaries, suggestive or insulting sounds, leering, whistling, or obscene gestures); and physical (unwanted physical contact, including touching, pinching, coerced sexual intercourse, or assault).

Such retaliatory action will be seen as a violation of this Code of Conduct and may result in the suspension or termination of the retaliating-participant’s inclusion in the organization.

Fact-Finding: Should the organization receive an incident report related to an alleged violation of this code of conduct, the report shall be brought to the attention of (1) the current Executive Director and (2) the Board of Directors. Collectively this group shall be referred to from this point on as the Investigative Advisory Panel (IAP). Should one or more of the aforementioned parties be cited in the report as the alleged offender, victim, or witness of a violation of the code of conduct, or should they serve as the complainant, they shall be excluded from the IAP. With notice, the involved parties reserve the right to disclose the complainant’s identity.

The IAP will convene to determine the complaint’s relevant clause of the Code of Conduct. Should the IAP identify a relevant and citable clause in the Ring of Keys Code of Conduct, they shall investigate the veracity of the alleged violation. The IAP reserves the right to request interviews and/or information from relevant parties to assess the facts. These requests shall include no less than (1) the complainant and (2) the alleged offender. The IAP reserves the right to request interviews and/or information from all other parties relevant to the report.

Determination: Upon completion of the fact-finding process outlined above, the IAP shall collect their findings and compile a confidential report to the Board of Directors. Should a participant of the Board of Directors be the alleged offender or alleged victim, they shall receive the report and be excluded from the determining vote. The Board’s determining participants shall convene to assess the report and determine the suitable course of action, up to and including: removal of a Key from the online database, exclusion from RoK community events & publicity materials, removal from the Board of Directors, termination of employment or termination of contract. Should a criminal act be alleged, the Board reserves the right to provide the IAP’s report to local, state, and/or federal authorities. Such action shall be determined by a majority vote of the determining participants of the Board of Directors. Should a majority fail to be reached, the complaint shall be closed and the complainant shall be notified.
